14950 MINUTES
The minutes of the meetings of the Council held on 1 December 2008, copies of which had been circulated, were taken as read and signed by the Mayor as correct.
14951 TOWN MAYOR’S ANNOUNCEMENTS
The Mayor reported that since the last meeting he had attended the following events:-
The planting of a tree at the newly formed Community Woodland. St John Ambulance Cadets presentation evening and carol service where many examples were seen of the hard work and time given by these young people to the local community. The annual Salvation Army carol service and a similar carol evening at Linden House.
The carol service at St John Primary School gave the Mayor the opportunity to thank the School for its involvement in the recent Civic Service.
The Mayor also drew Council’s attention to the recent sad death of Hans Stompf of Immenstadt. Herr Stompf had been instrumental in forging the twinning link between Wellington and Immenstadt and had played a large part in ensuring that the link had grown and flourished over the years.
14952 POLICE REPORT
Details were submitted of the latest crime figures for the area. Members were pleased to note that this had been another good month with a noticeable reduction in crime figures. Tributes were paid to the Police for the manner in which they carried out their duties during the New Year’s Eve festivities in the town.
14953 PUBLIC PARTICIPATION TIME
Mrs Anne Brummitt of Wellington Boots addressed the Council on the problems that had been experienced by local traders and shoppers alike during the interminable road works in the centre of town.
The Council, whilst acknowledging the situation, pointed out that there was little practical support that it could give. Members spoke generally about liaison with the organisations that represented the traders and expressed a wish to develop closer links with a view to promoting the town in a positive manner.
Resolved that:-
(a) the Town Clerk contact the Wellington Economic Partnership and the Chamber of Trade to see if there was any way in which the organisations could work more closely together and promote the town;
(b) the Highways Authority be asked if there were any plans to offer compensation to the traders who had been so adversely affected during the disruption caused by the road works.
14954. GRANT APPLICATIONS
(a) Cruse Bereavement Care
An application for a grant of £250 had been received from Cruse Bereavement Care for providing booklets and leaflets.
Resolved that a grant of £250 be made
(b) Friends of Wellington Park
An application for a grant of £1,750 had been from Friends of Wellington Park towards the cost of providing a programme of entertainment in the Park. It was noted that this application was for funding in the 2009/2010 financial year.
Resolved that a grant of £1,750 be made in the 2009/10 financial year.
14955 CAR PARK CHARGES 2009/10
Further to Minute 14927 (1 December 2008) the Town Clerk reported that representations had duly been made on behalf of this Council at a meeting of Taunton Deane’s Traffic Regulation Order Panel on 17 December 2008. Despite these representations Taunton Deane had decided to make no changes to the recommended increase in car parking charges.
Resolved that the position be noted
14956 MOBILE YOUTH SHELTER
With reference to Minute 14923 (1 December 2008) it was reported that the Partnership Support Officer, Taunton Deane Borough Council had indicated that were certain concerns in respect of this proposal that needed to be addressed before it proceeded further. The Town Council would be kept informed as the matter progressed.
Resolved that the report be noted.
14957 REQUEST FOR GRIT BIN OUTSIDE OF ST JOHN PRIMARY SCHOOL, PRIORY, WELLINGTON
Submitted details of a request for the provision of a grit bin on land at St John Primary School. The icy weather had caused problems for persons using the Priory entrance to the school. The cost of such a bin was estimated to be around £150.
Resolved that a grit bin be provided at the school.
14958 POWER OF WELL BEING
Councillor Mitton reported that Regulations had recently been passed which would enable certain qualified town and parish councils to undertake greater responsibilities. There were certain requirements necessary before these new duties could be conferred which included, amongst other things, having a CILCA qualified Clerk and having at least 80% of members suitably trained.
Resolved that the report be noted.
14959 PARISH PLAN
Councillor Mitton asked that a Working Party of Councillors be formed to consider the provision of a Parish Plan.
Resolved that Councillors Mitton, Critchard, Lloyd and Clark form a Working Party to consider this matter further.
14960 QUALITY COUNCILS
Councillor Mitton reported that there was to be a NALC “Stepping Stones” Conference in Coventry on 11 February which would be valuable in working towards Quality Council status. The Finance Committee had recommended that Councillor Mitton be authorised to attend this conference.
Resolved that the recommendation of the Finance Committee be agreed and Councillor Mitton be authorised to attend the conference with the cost being met by the Council.
14961 ALLOTMENTS COMMITTEE
Submitted the minutes of a meeting of the Allotments Committee held on 26 November 2008. Details of this meeting had already been reported to the Council at its meeting on 1 December 2008.

14962 WEB SITE WORKING PARTY
Submitted the notes of a meeting of the Web Site Working Party held on 4 December 2008.

14963 FOOTPATHS COMMITTEE
Submitted the minutes of a meeting of the Footpaths Committee held on 18 December 2008. Reference was made to the proposal to hold a site meeting in relation to a disputed footpath at Millstream Gardens. Caution was counselled in this case as the matter was already under consideration by the County Council.
Resolved that the minutes be noted and the recommendations contained therein be agreed.
14964 CHRISTMAS LIGHTS WORKING PARTY
It was reported that the Working Party would be meeting shortly to review provision of Christmas Lights in 2008 and give consideration to arrangements for 2009. It was noted that there were a number of differing views over the success or otherwise of the Christmas lights display this year.
Resolved that the position be noted.
14965. COUNCIL PAYMENTS AND RECEIPTS
The Clerk reported that the Council’s receipts for the period from 31 March to 31 December 2008 was £187,540 and the expenditure for the same period was £132,610. The Finance Committee had considered the report earlier in the evening when the Clerk had given a detailed explanation of all the figures.
Resolved that the report regarding Payments and Receipts be noted and approved subject to a double book keeping error regarding the payment of an individual allotment rent being corrected.

14967 APPOINTMENT OF INTERNAL AUDITOR
The Finance Committee had previously considered the appointment of an Internal Auditor to replace Tony Bullen who had recently resigned from that position. It had recommended the appointment of Bryan Howe of 23 Alexandra Road, Minehead.
Resolved that Bryan Howe be appointed as the Council’s Internal Auditor on the terms and conditions set out in his letter dated November 2008.

The Mayor (Councillor Critchard) and Councillor Copley stated that they were members of Taunton Deane Borough Council Planning Committee and reserved their right to vote differently at Taunton Deane Borough Council Planning Committee meeting than at the Town Council Planning meeting as different facts could be placed before them.
14943. APPLICATIONS TO BE DETERMINED BY TOWN COUNCIL:
Consideration was given to the following applications which were to be determined by the Town Council:
(a) Erection of single storey extension to 10 Post Close, Wellington (43/08/0139)
There appeared to be little impact on the street scene and the application was therefore felt to be acceptable.
Resolved that permission be GRANTED
(b) Conversion of garage to living accommodation at 9 Rope Walk, Wellington (43/08/0138).
This application was considered to be acceptable.

(c) Erection of single storey extension, demolition of outbuilding and erection of replacement building to provide Granny Annexe and erection of garden store at High View, Foxdown Hill, Wellington (43/08/128).
The Council agreed to suspend Standing Orders to allow the applicant, Mrs Jean Hoare to speak. Mrs Hoare said that no objections had been raised to this proposal. She also went on to explain the reasons why the “granny annexe” was to be provided.
The Council also received a report from the Planning Officer which recommended refusal because the proposed two storey granny annexe was tantamount to the erection of a separate dwelling. The plot was considered of insufficient size to accommodate a separate dwelling. It would also be out of character with the established layout and design of dwellings in the immediate vicinity and would have an adverse affect on amenity. Notwithstanding the objection to the proposed two storey development, a granny annexe in the form of an appropriately designed extension to Highview was considered to be acceptable.
Resolved that permission be REFUSED on the grounds set out in the Planning Officer’s report

14947. APPEAL DECISION
Installation of emergency storm water drain in front elevation soffit at Wellington Conservative Club, 19 High Street, Wellington (43/2007/188LB).
It was reported that this appeal had been DISMISSED. The Inspector concluded that the emergency overflow pipe harmed the character of the building, “diluting its homogeneity, which is intrinsic to its special interest. That unnecessarily compromises the architectural and historic interest of the building”.
14948. PARISH PLANNING AGREEMENTS
Detailed consideration was given to a letter from Tonya Meers, Legal and Democratic Services Manager, Taunton Deane Borough Council regarding the Parish Planning Agreements that gave certain parishes a level of delegated planning powers.
Mrs Meers had informed the Town Council that whilst reviewing some of the Deane’s processes and procedures it had come to her attention that these agreements had now expired and were due for renewal.
She explained that it was the intention of the Government to greatly reduce the numbers of minor applications made to local planning authorities and this might have an effect on the number of applications sent to parish councils to determine.
In addition, Taunton Deane would be reviewing the agreements to ensure that they accurately reflected the changes in Council procedures following the implementation of its new computer system. The Town Council had therefore been asked to confirm whether it still wished to continue with these agreements.
However in looking at these processes there was one part that concerned Mrs Meers, as Monitoring Officer, greatly and, in her opinion, could leave members of this Council open to challenge on the grounds of pre-determination and bias thereby making a decision unlawful. This was where the Borough Council were told that the Parish/Town Council disagreed with its view and wished to have the planning officer attend before making the decision. This, she felt, could give the impression that a decision had been made already.
The Town Council were informed that as a result of this, a new system would be imposed upon it with effect from1st January 2009. A list would be received from the Planning Department of all applications that it could deal with under its delegated powers and it would be given 14 days in which to respond to say which applications it wished to deal with. If no response was received within that time, then the Borough Council would assume that the Town Council did not wish to deal with an application.
The Town Council, after discussing this matter, confirmed that it would very much like to continue with the operation of a delegated planning agreement. The intention of the Government to reduce the number of minor applications was acknowledged, but notwithstanding this intention, the Council wished to continue to exercise the planning powers that the delegation agreement would allow. The Council emphasised how much it appreciated the presence and wise Counsel of Planning Officer John Hamer at it’s meeting and hoped that this would continue.
With regard to the Monitoring Officer’s concern about pre determination, the Town Clerk reported that he took an entirely different view to that expressed in her letter. The circumstances described related to issues of pre disposition not pre determination. Two completely separate things. He felt that the example given would not result in an unlawful decision being reached. All the Parish Councils would be doing, would be to gain further information before coming to a final decision.
The Town Council were most perturbed to have received a letter from the Monitoring Officer on Christmas Eve which unilaterally changed an Agreement on 1 January without any kind of prior notification or consultation. They were also concerned that they did not fully understand the new system that would operate from 1 January. If they were to receive a list of planning applications that could be dealt with under delegated powers and be given 14 days to respond, then the situation would remain unchanged to that that currently existed if it merely “called in” all the applications on the list. This was something that required further clarification.
It was further explained that these changes were designed to accommodate the new Accolade computer system, to improve performance targets and to provide protection to Parish Councils. Unfortunately the perception of members was that it was a move towards removing the delegation agreement and thus reducing the powers currently available to the Town Council. In addition, members were disappointed that the needs of a new computer system and hitting performance targets appeared to be taking precedence over local decision making and maintaining good relations between the Deane and the parishes – particularly at a time when the Government appeared to moving towards the introduction of greater powers for local councils.
Resolved that;
(a) Taunton Deane Borough Council be informed that the Town Council wish to continue with its Planning Agreement;
(b) the Monitoring Officer be informed of the concerns expressed in relation to this matter as set out in this minute.

The Town Council were most perturbed to have received a letter from the Monitoring Officer on Christmas Eve which unilaterally changed an Agreement on 1 January without any kind of prior notification or consultation. They were also concerned that they did not fully understand the new system that would operate from 1 January. If they were to receive a list of planning applications that could be dealt with under delegated powers and be given 14 days to respond, then the situation would remain unchanged to that that currently existed if it merely “called in” all the applications on the list. This was something that required further clarification.
It was further explained that these changes were designed to accommodate the new Accolade computer system, to improve performance targets and to provide protection to Parish Councils. Unfortunately the perception of members was that it was a move towards removing the delegation agreement and thus reducing the powers currently available to the Town Council. In addition, members were disappointed that the needs of a new computer system and hitting performance targets appeared to be taking precedence over local decision making and maintaining good relations between the Deane and the parishes – particularly at a time when the Government appeared to moving towards the introduction of greater powers for local councils.
Resolved that;
(a) Taunton Deane Borough Council be informed that the Town Council wish to continue with its Planning Agreement;
(b) the Monitoring Officer be informed of the concerns expressed in relation to this matter as set out in this minute.

Application for a grant of £1,750 from Friends of Wellington Park towards the cost of providing a programme of entertainment in the Park. This application was for funding in the 2009/2010 financial year.
RECOMMENDED that provision be made in the 2009/10 Revenue Estimates for a grant of £1,750 to be made.

Reported that attendance at this Conference would be valuable in working towards Quality Council status. The cost would be in the region of £65 plus expenses.
RECOMMENDED that Councillor Mitton be authorised to attend this conference and that the conference fee and associated expenses be met by the Council
